Accepting these terms
By accessing or using GoodPicksDB, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. “GoodPicksDB,” “we,” “us,” and “our” refer to the GoodPicksDB service operated by YA Industries in Texas, United States.
Eligibility
You must be at least 13 years old to use GoodPicksDB. If the law where you live requires a higher age to enter into this agreement, you may use the service only with the consent of a parent or legal guardian. You may not use the service if applicable law prohibits you from doing so.
Your account
You are responsible for providing accurate account information, keeping your credentials secure, and for activity under your account. Tell us promptly at [email protected] if you believe your account has been compromised. You may sign in with a verified email and password or with a supported third-party sign-in provider such as Google. Third-party services have their own terms.
The service
GoodPicksDB provides a curated way to discover, save, endorse, and discuss recommendations for movies, television, and books. Recommendations, descriptions, ratings, and editorial decisions are opinions and may be incomplete, inaccurate, unavailable, or unsuitable for you. We do not guarantee that any title, link, image, or third-party offering will remain available.
Your submissions
You keep ownership of original pitches and other content you submit. You grant YA Industries a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, moderate, edit for clarity, display, and distribute that content for operating, improving, and promoting GoodPicksDB. This license continues for content incorporated into the public catalog after account deletion, but we may de-identify it.
You represent that you have the rights needed to submit your content and that it does not violate law or another person’s rights. We may accept, reject, edit, unpublish, merge, or remove submissions in our editorial discretion and are not required to publish or preserve them.
Acceptable use
You may not:
- Break the law, infringe intellectual-property or privacy rights, or impersonate another person.
- Submit unlawful, threatening, harassing, hateful, deceptive, obscene, or malicious material.
- Use automated means to scrape, overload, probe, or disrupt the service without written permission.
- Bypass access controls, rate limits, security measures, or account restrictions.
- Upload malware, exploit vulnerabilities, or interfere with another user’s access.
- Use the service or its data to build a competing dataset or product without written permission.
Our materials
GoodPicksDB’s software, design, branding, compilation, and original editorial materials belong to YA Industries or its licensors and are protected by law. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service as intended. They do not transfer ownership or grant permission to use our trademarks.
Movie, television, book, and other third-party names, images, descriptions, and marks belong to their respective owners. Their appearance does not imply endorsement or affiliation.
Suspension and termination
You may stop using GoodPicksDB at any time and may delete your signed-in account in Settings. We may restrict, suspend, or terminate access, remove content, or block devices or addresses when we reasonably believe these terms were violated, the service or another person is at risk, or law requires it. Provisions that by their nature should survive termination—including licenses, ownership, disclaimers, limits of liability, and dispute terms—will survive.
Changes and availability
We may change, suspend, or discontinue any part of GoodPicksDB. We may also update these terms. The updated terms will be posted here with a new effective date. If a material change requires additional notice or consent under applicable law, we will provide it. Continued use after the updated terms take effect means you accept them.
Disclaimers
To the fullest extent permitted by law, GoodPicksDB is provided “as is” and “as available.” YA Industries disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or secure operation. Nothing in these terms excludes a warranty or right that applicable law says cannot be excluded.
Limitation of liability
To the fullest extent permitted by law, YA Industries and its owner, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the service. Our total liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid us for the service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
Governing law and disputes
These terms are governed by Texas law, without regard to conflict-of-law rules. Any dispute that is not eligible for small-claims court must be brought in the state or federal courts serving Travis County, Texas, and you and YA Industries consent to those courts’ jurisdiction and venue. Applicable consumer law in your home jurisdiction may give you rights that cannot be waived.
General terms
These terms and the Privacy Policy are the entire agreement about GoodPicksDB. If one provision is unenforceable, the rest remain effective. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them as part of a reorganization or transfer of the service. Headings are for convenience only.
